Terms of Use (TOU)

I. Purpose and Scope

These Terms of Use (TOU) govern the access and use of the Undead Survival website, as well as all associated digital services and tools (account creation, character management, game tools, discussion areas).

Registration and use of the Site imply the User's unreserved acceptance of these TOU.

II. Access and Registration

  1. Registration Requirements: The User must be at least 15 years old, or have the authorization of a legal representative if a minor, to create an account.
  2. Credentials: The User is responsible for the confidentiality of their password and undertakes not to share it.

III. Intellectual Property of the Site

  1. Site Ownership: The entire content of the site, including the game universe, the game system, the rules, illustrations, and graphic design, is the exclusive property of Rémi Demoulin and is protected by copyright.
  2. Unauthorized Use: Any reproduction, adaptation, or use for commercial or profitable purposes of the Site's content without the prior written consent of the Publisher is strictly prohibited and subject to legal action.
  3. Exception (Fan-Creations): The Publisher encourages the creation of fan-arts, unofficial scenarios, and any other derivative work, provided that it is non-commercial, cited, and clearly identified as unofficial.

IV. Intellectual Property of User Creations

  1. User Ownership: Texts and creative elements authored by the User (such as character background, personal scenarios, game histories, etc.) belong to them.
  2. License Granted to the Publisher: To allow the display, hosting, and sharing of content on the Site, the User grants the Publisher a free, non-exclusive license to host, display, reproduce, and distribute said content solely within the scope of the Undead Survival services.
  3. Content Linked to the Universe: The User acknowledges that their creations remain linked to the Undead Survival universe, which remains the property of the Publisher.

V. User Obligations and Conduct

The User agrees to comply with the following rules:

  1. Respect for Others: The User commits to showing respect towards other members and the moderation team. Injurious, defamatory, racist, xenophobic, or any illegal content is strictly prohibited.
  2. Names and Texts: Usernames, character names, and texts (histories, discussions) must remain correct and decent. Acceptable puns are allowed, but any obscenity or abusive provocation is prohibited.
  3. Content: The User commits not to publish content that violates applicable law.

VI. Moderation and Penalties

The Publisher reserves the right to moderate, edit, or delete any content deemed non-compliant with these TOU.

  1. Warning System (Blame): In case of a moderate violation of the rules of conduct, the User will receive a warning (Blame).
    • The accumulation of three (3) Blames may lead to temporary suspension or permanent banning of the account.
  2. Immediate Ban: The Publisher reserves the right to enforce a permanent ban without prior notice in the event of a serious act, including:
    • Harassment, threats, or personal attacks.
    • Any attempt at hacking, site attack, or fraud.
    • Publication of illegal or hateful content.

VII. Modification of the TOU

The Publisher reserves the right to modify these TOU at any time. Users will be informed of modifications via a notification on the Site or by email. Continued use of the Site after the modification constitutes acceptance of the new TOU.
